hiya everyone,
Has anyone appealed against the DLA rate they've been given? Elliott's rate has been dropped to middle rate due to them claiming that he only has care needs for some time during the day. I did go into great detail about the care he still needs at night since his bowel surgery and explained in length about his sleep apnea, but it seems they have totally overlooked this. How do i go about appealing ? any help will be gratefully received.

Defo appeal it. You have nothing to lose and don't forget the 15-20 minutes rule

Everything you do during the day and during the night is for at least 15 - 20 minutes

I appealed when i applied for it the 1st time. Brodie was only given lower rate care and after i appealed and he was given middle rate. I wrote a letter asking for someone to look at the decision again and re-wrote everything i'd put on the original form, i'm sure it just depends on who looks at it as i don't remember writing anything on the letter that hadn't already been written before! If you do decide to appeal make sure you do it ASAP as i think you only have about a month to do it. Good Luck

omg that is sooo wrong that they didnt give u high rate. I get high rate for josh and all i have to do is change him and his bed sheets if he is sick due to his stomach reflux and change his bum as he is still in nappies at night.

Well i gave Elliott's paed nurse a ring and told her about his DLA, and she's going to sort it out on my behalf, so glad due to lack of sleep and problems at work what i really need is a soft pillow and a quiet room, not more bloody forms GRRRRRRRRRRRRR. will let you know the outcome xx

Well I've put in an appeal over the telephone and now have to wait again for it to be re looked at,fingers crossed that it wont take too long. Reading through your replies i have not mentioned that Elliott is still in nappies to them hope this wont make too much of a difference. Hate dla form filling surly there has to bee an easier way? xx

At last, DLA has come back and Elliott's rate has been put back up to the higher rate. Mad thing is that I didn't tell them anything different when I appealed that what i put on the original form !! xx
